Terms of Partnership & Service Agreement

A Foundation of Clarity

Welcome. This document outlines the essential terms of our professional partnership when you engage with ThatSeller for our digital growth services. By visiting our website or initiating a project, you acknowledge and agree to these terms. We’ve crafted this to be clear and direct, because a strong partnership is built on mutual understanding, not hidden clauses.

Section 1: Ownership & Intellectual Property

1.1 Our Digital Home
All content on thatseller.com—including our logo, text, graphics, interface design, and the strategic frameworks we describe (like the “Market Domination System”)—constitutes our intellectual property. You may view and use this site for your own informational purposes, but reproduction, distribution, or creation of derivative works without our explicit written consent is prohibited.

1.2 The Work We Create For You
Upon full and final payment for any project, we grant you a perpetual, non-exclusive license to use the final deliverables (e.g., website copy, campaign designs, strategy documents) for your own business purposes. We retain the right to showcase this work in our portfolio and case studies to demonstrate our capabilities. Any pre-existing materials or tools we bring to the partnership remain our property.

Section 2: Financial Agreement & Project Engagement

2.1 Service Fees & Recurring Billing
Unless otherwise specified in a signed proposal, our services—including SEO, PPC, Social Media Management, and Content Strategy—are offered on a monthly retainer basis. Fees are billed in advance and are due upon receipt of invoice. Project-based work (e.g., website development, brand audits) requires a mutually agreed-upon scope and payment schedule, typically starting with an upfront deposit.

2.2 Your Role: Timely Feedback & Approval
Our process is collaborative and requires your active participation. We rely on your timely feedback and formal approval at key project stages to meet deadlines. If we do not receive necessary feedback or assets from you for 30 consecutive days, we reserve the right to place the project on hold or consider it completed, with all fees due and payable.

Section 3: Our Commitments & Shared Responsibilities

3.1 The Nature of Digital Marketing
We practice ethical, “white-hat” strategies aligned with platform guidelines (e.g., Google, Meta). However, the digital landscape is inherently dynamic. We do not guarantee specific results, such as ranking #1 in SERPs, unrealistic growth in traffic, or a guaranteed % of ROI. Success is influenced by market volatility, algorithm changes, and your industry’s competitive landscape.

3.2 Hosting, Access & Your Website’s Health
To perform our work, we often require access to your digital assets (e.g., website backend, ad accounts). You grant us the necessary access level to execute the agreed services. We strongly recommend you:

  • Maintain regular, complete backups of your website.

  • Avoid making unilateral changes to optimized pages (like meta tags, core content, or site structure) without consulting us, as this can nullify our work.

  • Update any login credentials shared with us after project completion for your security.

3.3 Limitation of Liability
To the fullest extent permitted by law, ThatSeller’s total liability to you for any claim arising from our services shall be limited to the total fees you paid for the specific service in question. We shall not be liable for any indirect, consequential, or incidental damages, including lost profits, data loss, or search engine penalties arising from factors beyond our reasonable control.

Section 4: Imagery, Content & Legal Use

4.1 Imagery in Our Work
For client projects, we source imagery from licensed stock libraries or assets you provide. We ensure proper licensing for stock imagery, but if you require exclusive rights to a specific image, additional licensing fees may apply. You are responsible for ensuring any brand assets, trademarks, or imagery you provide to us for use have the appropriate rights and permissions.

Section 5: Evolution of Our Agreement

5.1 Changes to These Terms
The digital world doesn’t stand still, and neither can our guidelines. We may update these Terms of Service periodically to reflect changes in our services or for legal clarity. The most current version will always be posted on this page with an updated “Last Revised” date. For significant changes, we will make reasonable efforts to notify our active clients via email.

Your continued use of thatseller website or services after such changes constitutes your acceptance.

Section 6: How to Reach Us

Our door is always open for clarity. If you have any questions about these Terms, please initiate a conversation with us. It’s the best way to ensure we’re aligned.
